Yes, they are the same. Just as the original Mickey Mouse looks very different from the movern version. The comic was published by Dell Comics, and maybe some other after that. I'm not an expert. Yes, but it is the original Oswald that Disney owns. The later and more modern Oswald was so different from it that I would be weird if they owned this version too. So who owns the modern version of Oswald? The only thing he has in common with the original is the name and that he is a rabbit. Some of the comics about him and his friende Toby could probably have been made into a movie. To do this, I guess all they need is to change his name.
